LAW4 778 - War Crimes (JAG)


In the last decade, no source of law has made more significant contributions to the law of war than the international criminal law of armed conflict.  In this course, students will survey the jurisprudence of both traditional (military commissions, courts-martial, and international tribunals) and emerging forums (International Criminal Court, hybrid tribunals, national tribunals, truth and reconciliation commissions).  The course will offer opportunities for critical analysis of the often conflicting goals of justice and peace, the complexities of international and domestic jurisdiction, and the challenges of identifying substantive crimes under the law of war.
