LAW7 619 - Supreme Court from Warren to Roberts


The Supreme Court under Chief Justice Earl Warren is remembered as having been one of the most activist courts in American history. During the years of Chief Justice Warren Burger, the Court seemed to lack a sense of direction, and the counter-revolution some observers had predicted never came about. What will be the legacy of the Court during the time of Chief Justice William H. Rehnquist? Among the themes likely to be developed in this seminar are the origins of the Warren Court, that Court’s legacy, and the extent to which that legacy survives today; the relation between presidential politics and the work of the Court; the interplay between the Court and the country at large; specific doctrinal developments; the philosophies of the individual justices; and voting blocs and behavior on the Court.
